Covert surveillance comes in many forms: from physically watching and monitoring persons and behaviour to gathering intelligence on idividuals and organisations from whatever means possible.

A popular means of gathering formerly hidden information is the online resource of WikiLeaks. This site aims to publicise leaked material that they believe will be of public interest. This will cover Governmental and influential organisational activity around the globe (WikiLeaks were the first resource to reveal the helicopter gunship video of US military attacking civilians in Iraq). Hand in hand with leaking sensitive material is protecting the anonymity of the informant.

In 2008, the US Government made it clear that anybody found to be leaking information to the WikiLeaks website would face immediate termination of employment as well as criminal prosecution. The concern of WikiLeaks was that this worry would prevent whistle-blowers coming forward with important information. However, it seems, to date, their worries were unfounded.

Incensed at percieved injustices, informants have continued to reveal hidden truths about a wide range of subjects and continue to be a rich source of information in covert surveillance. Nobody has been uncovered as an informant and anonymity has been preserved so the hope is that the service can continue – much to the consternation of those with something to hide!

However, in a new turn of events, The Digital Economy Bill is to be re-visited at the House of Commons and is suspected to become law very soon. This affects those downloading copyrighted material, either deliberately or accidentally, by way of being forceably disconnected from the internet after a short series of warnings. It will also enable owners of copyright protected material to block those tryingt to access private material.

This type of activity is notoriously difficult to monitor though – estimates currently sit at £1.2 bn loss in the UK in 2008 due to illegal file sharing. Much of this could be done through internet cafes and as the law stands, the cafe owner would be held responsible rather than the user, and face prosecution. So, the Bill is flawed in many ways – proving responsibility of the downloading of material and the fact that illegal downloads are difficult to track.

Internet service providers regularly monitor network traffic as a means of security and are able to pick up on file sharing. However, it is much more difficult to work out what exactly is being shared and responsibility of that would fall to the copyright owner. Although a lengthy process, this can be done.

It is believed that this new Bill, if passed, will seriously inhibit the WikiLeaks site. The release of copyright material could cause the site to be shut down and, at the very least, it will mean that teh owners of the material would be able to identify exactly where the information came from leading to job losses and a drying up of information.

We live in a country that supports freedom of speech yet then employees big brother to watch our every move and try to control it – hardly a democracy.
